Charter says Gary schools haven’t paid legal fees owed

Updated: February 13, 2013 6:06AM

Gary Community School Corp. still hasn’t paid about $10,000 in legal fees a federal judge ordered it to fork over after making frivolous arguments in a lawsuit filed by charter school operator LEAD College Preparatory.

LEAD sued the school district when it tried to buy the former Ernie Pyle Elementary School for a charter school for $1, as required by Indiana law for empty schools, and Gary wouldn’t cooperate.

The district had the case moved from Lake County to U.S. District Court in Hammond. However, a federal judge ordered the case back to the county level, saying it should never have been moved.

He ordered the district in October to pay LEAD’s legal fees. According to a news release from LEAD’s attorney, Trent McCain, the school district still hasn’t paid that money. He has filed another motion to enforce the order.
