The criminal trial against a man accused of molesting a Lake Station boy during a cross-country trip continued Tuesday with another local child testifying about how he woke up one night to discover the defendant touching the child’s genitals.
The boy, identified as K.M., said his good friend and the victim in the case, A.M., invited him during the summer of 2008 to go to a pool and slumber party that David Alan Resnick, 33, of Lucie, Fla., was hosting.
The boy, who was 8 years old, was told other children and adults were going to the pool party, but K.M. and A.M. soon discovered themselves alone with Resnick.
K.M. said he had fun at first, swimming in the pool with Resnick. That’s when Resnick threw him up in the air several times, and K.M.’s swim trucks fell down to his knees each time. The boy told the jurors that Resnick laughed when it happened.
K.M. eventually found himself alone with Resnick in his hotel room after Resnick took A.M. home. K.M. asked if he could sleep in a chair.
“He said it would be uncomfortable,” K.M. testified.
The two then shared a bed together, and when K.M. woke up in the middle of the night, Resnick was rubbing his genitals, he said.
“I was saying, David, stop,” K.M. said, adding that he felt uncomfortable.
Resnick, who had his eyes closed and never said anything, didn’t respond, however, and K.M. then left the bed to sleep in the chair.
K.M. said he didn’t tell his mother at first because he “was scared ... to get in trouble with my mom.”
His mother later testified that A.M.’s mother had told her other kids and adults would be at the pool party and that several of them, including other adults, would stay for the slumber party.
She had met Resnick several times at A.M.’s house, she said, but would never have let K.M. go to the party if she knew he would be the only one. He also never told her that he slept alone with her son.
Resnick, who was a friend of A.M.’s family, is accused of molesting the boy with him as he drove his semi-trailer on a two-week trip around the northwest of the country. He also faces counts of showing child pornography to A.M., using a gun during his crimes and possessing a gun as a felon.
A.M. testified at the start of the trial Monday that Resnick at first started by touching him and showing him child pornography and then escalated to oral sex and eventually sodomized him at the end of the trip at the Comfort Inn in Hobart, the same hotel where he would a few days later host the pool party.
William Donaldson, a supervisory special agent for the FBI’s behavioral analysis unit, testified Tuesday that many child predators pick their victims by looking for children who feel alone and are in some way facing family problems and then ingratiate them and their family by giving them gifts. They then slowly get the child comfortable by showing them pornography and touching them in seemingly casual ways, one of which can be wrestling in the pool, Donaldson said.
The government also presented evidence showing Resnick was checked into the Comfort Inn during the alleged time and that police found child pornography on his computer after he moved from northern Indiana to Florida.
Testimony in the case is expected to conclude Wednesday.
