7 highway employees sue Lake County for overtime pay

Seven employees of the Lake County Highway Department are suing the county, claiming they have not been properly paid for the overtime they worked.
The lawsuit, filed Thursday in U.S. District Court in Hammond, claims the county used to pay the the plaintiffs — David Durham, Ronald Gregory, Rodney L. Kozyra, John C. Rust, Jan Smoljan, Kenneth R. Taylor, James R. Russell and Kenny Wood — for overtime hours but decided to claim the employees are exempt from overtime pay because they have fixed salaries.
The suit does not say how much overtime the plaintiffs claim they worked and were not paid for, but it says the policy has been in place two years. The plaintiffs are asking for unspecified damages and legal fees.
John Dull, attorney for the Lake County commissioners, declined to comment on the case.
