Judge delays Weinberger sentencing

HAMMOND, Indiana (AP) — A U.S. district judge has granted a delay in the sentencing of a former Merrillville surgeon who pleaded guilty to federal health care fraud charges after more than five years on the run.
Mark Weinberger was scheduled to be sentenced Feb. 24. District Judge Philip Simon in Hammond issued an order Thursday delaying the sentencing, saying the probation office needed more time to prepare its presentence report.
Simon says the report will be critical to whether he accepts a plea agreement.
Under the agreement, the 47-year-old Weinberger would be sentenced to up to four years in prison. He pleaded guilty in October to 22 counts alleging that he billed insurers and patients for procedures he didn’t perform. Some victims have complained the four-year sentence is too light.
