Federal guidelines call for a former Chicago police officer to serve life in prison after pleading guilty to racketeering conspiracy as an accomplice of the Latin Kings street gang but federal prosecutors recommend he serve 19 years.
The government filed a sentencing memorandum on Alex Guerrero Wednesday, saying that he received 43 points in the federal sentencing guidelines, which is equal to life in prison. However, Guerrero’s plea agreement with the government called for prosecutors to request that he instead serve 19 years in prison.
The request is not binding upon the court, although federal judges usually follow the recommendations made in plea agreements.
Guerrero pleaded guilty this summer in the case and testified against one of the Latin Kings members, Martin Anaya, in September. He described how he and partner Antonio Martinez Jr. used their badges to stop people in Chicago and break into homes in Northwest Indiana to steal guns, money and drugs for the Latin Kings.
